His will was signed March 28, 1749 and probated in September 1760. The following extracts from his will may be interesting:

According to Margaret Clay's notes in the British Museum in London (which I have never seen, but picked up from a responsible authority). Sir John Clay (1558-1632), Coal Baron of Wales, was knighted by Queen Elizabeth. (Perhaps they were having a heating crisis in England at that time). It is said that he was a great-grandson of the JOHN CLAY who was knighted by King Edward IV for action in the Battle of Tewkesbury in 1471. He had a son. Captain John Clay (1587-1656) who was a British Grenadier.

Arrived at Jamestown in 1613 on Captain Samuel Argall's ship, "Treasurer".Henrico County, Virginia: Beginnings of Its Families: Part I William Clayton Torrence William and Mary College Quarterly Historical Magazine, Vol. 24, No. 2. (Oct., 1915), pp. 116-142. (1) John Clay had a patent 13 July 1635 for 1200 acres in Charles City [now Prince George] Co., adjoining lands of Capt. Francis Hooke, up to the head of Ward's Creek and bounded north on James River, said land due 100 acres to said Clay as an old planter before the government of Sir Thomas Dale and the other 1100 acres for the transportation of 22 persons. In 1655 William Bayly patented 400 acreson Ward's Creek, Charles City Co. purchased of William Clay son of John Clay, who was assignee of Francis Hooke who patented in 1637. "These persons may have been ancestors of Henry Clay whose first recorded ancestory Henry [Charles] Clay was living in that part of Henrico now Chesterfield when the records begin in 1677. there was a Clay family in Surry Co. from an early date". W. G. Stanard in Virginia Magazine, III, p. 186. In the Musters of Virginia 1625 (Hotten, Emigrants, p. 211) "Jordan's Journey, Charles City . . . John Claye, arrived in the Treasurer Feby. 1613; Anne, his wife, in the Ann, August 1623; servant Wm. Nicholls, aged 25 years in the Dutie, May 1619". Charles Clay (first known ancestor of the Henrico Co. family) was born about 1647 and died in 1686. He lived in that part of Henrico now Chesterfield Co. not many miles from the "Old Town" settlement which was about opposite to the site of the present city of Petersburg Charles City Co., Va Records Reisiger Page 153 Fragment of an Order Book Book 1641-1642 Thomas Drawsey professed to court that JOHN CLAY, Sr. owed him 50 lbs tobacco, and CLAY is to pay Treesearching with Doris Boyd Co, Press Observer Jan 19, 1976 Sir John Clay (1558-1632) had a son Captain JOHN CLAY (1587-1656) who was a British Grenadier. Would you like to know what a British Grenadier was? I was curious, and found that apparently he was one of a special company of soldiers attached to each British regiment or battalion. This company was posted at the right of the battle line, and its members wore a special uniform. It must have been an elite corps, with an outstanding leader as captain. Was it love of adventure or ambition to become a prosperous landowner which brought Captain JOHN to Virginia at the age of 26 on the ship Treasurer, arriving in February of 1613? If the later, he achieved his desire. He was married in Virginia to ANN Nichols, who arrived on the ship Ann in August , 1623. Wonder if she was one of the maids brought out as wives for the colonists or a girl he had known who had inspired him to come to America to find a home for them? Captain JOHN and ANN settled at Jordans Journey in Charles City County. He had a patent, dated July 13, 1635, for 1200 acres of land, the first 100 due him as an "old planter" before the government of Sir Thomas Dale, and the other 1100 for "transporting" (paying for passage of) 22 emigrants. This couple had four sons: Francis, William, Thomas, and Charles. (I believe they had one child, William Clay and John remarried Elizabeth and had on known son, Charles Clay who married Hannah Wilson.) John Thomas Clay, son of Sir John Clay landed at Jamestown, VA in 1613 and settled in Charles City County, Virginia. John Thomas Clay, the Grenadier (hired soldier in the King's army) arrived in the new world in February 1613 according to the muster on the TREASURER. The TREASURER was commanded and partially owned by Captain Samuel Argall, who was a brother of Elizabeth Argall Filmer, ancestress of Martha & Lucy Green Clay (wife of Henry Clay 1713-1764). 54,124

alternate birth place of Chesterfield County, Virginia.
alternate birth place of Bedford County, Virginia.
alternate death date of September 16, 1774.
William Mitchell Clay died on September 10, 1774, while hunting deer for Col. John Field's company of independent Rangers. He was part of the unit assembled under Gen. Andrew Lewis travelling to Point Pleasant to participate in the impending battle. Though it is not clear why a 64 year old man would be making a 250 mile journey on foot, he earned the dubious distinction of becoming the unit's first casualty.
According to researchers on this line his wife Agnes deserted him, for no wife appears on deeds from 1771 "on".
1765, He found on deed in Bedford County, Virginia buying land from William mead.
In 1768, William Clay placed an advertisement in the Virginia Gazette stating that "...my wife Agnes has eloped from my bed, and robbed me of things of considerable value and I expect will endeavor to run me in debt, Itherefore forewarn all persons from dealing with her on my account as I will pay no debts of her contracting" William and Agnes were either back together in 1769, or she was living alone but still using his name, since she gave a deposition in the Chesterfield County court of May 5, 1769.
He lived in Henrico, Chesterfield, Cumberland, Bedford and Pittsylvania Cos. VA.
His Last deed was recored in 1773 in Pittsyvania Co., Virginia. He married (1) 1730 in Henrico County, Virginia, Martha Runyan, b. 1713 in Henrico County, Virginia, d.
